HRK ELECTRICAL SOLUTIONS LTD

TERMS & CONDITIONS OF BUSINESS

Last updated: 3 October 2026

These Terms and Conditions apply to electrical installation, inspection, testing, maintenance, fault finding, repair and associated services supplied by HRK Electrical Solutions Ltd.

Please read these Terms and Conditions carefully before accepting a quotation or instructing us to commence work.

1. ABOUT US

Throughout these Terms:

"we", "us" and "our" means HRK Electrical Solutions Ltd.

"you", "your" and "customer" means the individual, business or organisation purchasing or requesting our services.

"works" means the goods and/or services described within our quotation, estimate, invoice, job sheet or other written agreement.

"consumer" means an individual acting wholly or mainly for purposes outside their trade, business, craft or profession.

"business customer" means a customer acting wholly or mainly for the purposes of a trade, business, craft or profession.

2. ACCEPTANCE OF THESE TERMS

These Terms and Conditions form part of the agreement between HRK Electrical Solutions Ltd and the customer.

You will normally be treated as having accepted these Terms when you:

  • accept our quotation;

  • sign or electronically approve our proposal;

  • pay a deposit;

  • instruct us in writing to proceed;

  • expressly instruct us to commence work; or

  • otherwise enter into a contract with us.

Where there is any conflict between these Terms and an expressly agreed written quotation or contract, the specifically agreed written terms will take priority to the extent of that conflict.

Nothing in these Terms affects the statutory rights of a consumer.

3. QUOTATIONS

Unless otherwise stated, quotations issued by HRK Electrical Solutions Ltd are valid for 30 days from the date of issue.

A quotation is based on:

  • information supplied by the customer;

  • any site inspection undertaken;

  • the visible and reasonably accessible condition of the existing installation;

  • information available to us at the time; and

  • the scope of work specifically described within the quotation.

Only the work specifically described within the quotation is included in the quoted price.

Any additional work may incur an additional charge.

Where a quotation has been prepared using photographs, plans, descriptions, measurements or other information supplied remotely, the quotation may need to be revised if the actual site conditions differ materially from the information supplied.

We reserve the right to correct obvious clerical, calculation or pricing errors before work commences.

4. ESTIMATES

Where a price is described as an estimate, it represents our reasonable assessment of the likely cost of the work rather than a guaranteed fixed price.

The final price may vary depending upon:

  • actual labour required;

  • materials used;

  • unforeseen defects;

  • access restrictions;

  • changes to the customer's requirements; or

  • other circumstances that could not reasonably have been identified beforehand.

Where reasonably possible, we will notify you before materially exceeding an estimate.

5. PRICES AND VAT

Prices will be stated within the relevant quotation or estimate.

Our quotation will indicate whether VAT is applicable and whether quoted amounts are inclusive or exclusive of VAT.

Where applicable, VAT will be charged at the prevailing statutory rate.

Additional costs that may apply where not already included include:

  • parking charges;

  • congestion or clean-air-zone charges;

  • permits;

  • specialist access equipment;

  • scaffold or access towers;

  • waste-disposal charges;

  • specialist testing;

  • DNO or utility charges;

  • Building Control fees; and

  • other necessary third-party costs.

Any material additional cost will be discussed with the customer where reasonably practicable before it is incurred.

6. DEPOSITS

We may require a deposit before:

  • reserving a substantial period of labour;

  • ordering materials;

  • ordering bespoke equipment;

  • commencing larger projects; or

  • undertaking work with substantial upfront costs.

The required deposit will be stated within the quotation.

A deposit is not automatically non-refundable.

If you cancel the contract, we may retain an amount reasonably reflecting actual costs or losses incurred as a result of the cancellation, including:

  • materials already purchased;

  • bespoke or non-returnable items;

  • reasonable supplier restocking charges;

  • work already carried out;

  • reasonable administration costs directly attributable to the cancellation; and

  • other genuine losses we are legally entitled to recover.

We will take reasonable steps to minimise our losses.

Any amount of the deposit that we are not reasonably entitled to retain will be refunded.

Consumer statutory cancellation rights remain unaffected.

7. PAYMENT TERMS

Unless otherwise stated within the quotation or invoice, invoices are due for payment within 7 calendar days of the invoice date.

For larger projects, we may require staged payments.

Where staged payments apply, the payment schedule will be stated within the quotation or agreed before commencement.

We may require payment at stages including:

  • deposit;

  • first fix;

  • second fix;

  • installation of major equipment;

  • substantial completion; and

  • final completion.

Stage payments become due when the relevant agreed stage has been substantially completed.

Any genuine dispute regarding an invoice should be brought to our attention promptly.

The customer should identify:

  • the invoice concerned;

  • the amount disputed; and

  • the reason for the dispute.

Any undisputed portion of the invoice remains payable.

8. LATE PAYMENT – BUSINESS CUSTOMERS

Where you are a business customer and payment becomes overdue, HRK Electrical Solutions Ltd reserves the right to claim statutory interest, compensation and reasonable debt-recovery costs where permitted under the Late Payment of Commercial Debts (Interest) Act 1998 and associated legislation.

We also reserve the right to suspend further work where undisputed invoices remain overdue, where it is reasonable and lawful to do so.

Any suspension may result in changes to completion dates.

9. LATE PAYMENT – DOMESTIC CUSTOMERS

Where a consumer invoice becomes overdue, we may contact you to request payment.

Where payment remains outstanding, we reserve the right to take reasonable debt-recovery action.

This may include:

  • payment reminders;

  • formal demands for payment;

  • debt-recovery services;

  • a letter before action; and

  • court proceedings.

Any interest or recovery costs charged to a consumer will only be those that are fair, proportionate and legally recoverable.

10. RIGHT TO CANCEL – CONSUMERS

Where you are a consumer and your contract has been entered into:

  • online;

  • by telephone;

  • through electronic communication; or

  • away from our business premises,

you may have a statutory right to cancel the contract.

Where the statutory cancellation right applies to a service contract, the cancellation period will normally end 14 days after the day on which the contract was entered into.

You do not need to provide a reason for exercising a valid statutory right to cancel.

To cancel, you must communicate a clear statement to HRK Electrical Solutions Ltd confirming that you wish to cancel the contract.

You may contact us at:

HRK Electrical Solutions Ltd
5 Faraday Corner
Shefford
Bedfordshire
SG17 5ZG

Email: Enquiries@hrk-electrical.com

A model cancellation form is provided at the end of these Terms.

You are not required to use the form provided that your decision to cancel is clearly communicated to us.

11. STARTING WORK DURING THE CANCELLATION PERIOD

You may ask HRK Electrical Solutions Ltd to commence work before an applicable 14-day cancellation period expires.

Where required by law, we will obtain your express request to begin the service early.

If you request that work begins during the cancellation period and subsequently exercise a valid cancellation right, you may be required to pay a proportionate amount for services properly provided before we received your cancellation.

Where:

  • you expressly requested that the service begin during the cancellation period;

  • the service has been fully completed; and

  • the applicable statutory requirements have been satisfied,

you may lose the right to cancel once the service has been fully performed.

An Early Commencement Request is included at the end of these Terms.

12. URGENT REPAIRS AND EMERGENCY CALL-OUTS

Different cancellation rules may apply where you specifically request that we attend your property for the purpose of carrying out urgent repairs or maintenance.

Where the statutory urgent-repair exemption applies, the cancellation right may not apply to the urgent work specifically requested or to replacement parts necessarily used to carry out that urgent repair.

Any additional non-urgent work offered or requested during the same visit may remain subject to normal consumer cancellation rights.

13. CANCELLATION BY THE CUSTOMER

Outside any statutory cancellation period, customers should provide as much notice as reasonably possible if they wish to cancel booked work.

Where cancellation causes us a genuine financial loss, we may recover reasonable costs incurred as a direct result.

These may include:

  • materials purchased specifically for the job;

  • non-returnable products;

  • bespoke equipment;

  • supplier cancellation charges;

  • specialist equipment already hired;

  • work already completed; and

  • other reasonable direct losses.

Cancellation charges will not be used as a penalty and will reflect genuine loss.

14. RESCHEDULING

We understand that customers may occasionally need to rearrange an appointment.

We ask for as much notice as reasonably possible.

Where repeated or very late rescheduling causes unavoidable costs, we reserve the right to recover reasonable costs directly resulting from that change.

We may also need to rearrange work because of circumstances including:

  • illness;

  • emergencies;

  • adverse weather;

  • supplier delays;

  • material shortages;

  • vehicle breakdown;

  • unsafe working conditions;

  • another contractor's delay; or

  • circumstances outside our reasonable control.

Where this occurs, we will contact you and arrange a revised date as soon as reasonably practicable.

15. ADDITIONAL WORK AND VARIATIONS

The agreed price only covers the work specified within the quotation.

Any changes requested by the customer may result in a variation to the price and programme.

Additional works may include:

  • extra sockets;

  • additional lighting;

  • altered accessory positions;

  • additional circuits;

  • upgraded equipment;

  • additional remedial works;

  • changes requested after installation has commenced; or

  • work arising from previously concealed defects.

Where reasonably practicable, additional work and its cost will be agreed before it is undertaken.

Agreement may be provided through:

  • email;

  • text message;

  • electronic quotation system;

  • written variation;

  • signed instruction; or

  • another clear form of agreement.

Where urgent work is required to remove an immediate danger, we will attempt to contact the customer before proceeding wherever reasonably practicable.

16. UNFORESEEN CONDITIONS

Electrical installations often contain defects that cannot reasonably be identified until work or testing begins.

Examples include:

  • damaged concealed cables;

  • inadequate earthing arrangements;

  • missing or inadequate protective bonding;

  • insulation resistance faults;

  • borrowed neutrals;

  • incorrect circuit identification;

  • unsuitable cable sizes;

  • deteriorated wiring;

  • inaccessible junctions;

  • damaged accessories;

  • hidden alterations;

  • overloaded circuits;

  • water ingress;

  • asbestos or suspected asbestos-containing materials;

  • structural defects; or

  • unsafe work previously undertaken by others.

Unless specifically included within the quotation, rectification of previously unknown defects is not included in the original price.

Where additional defects are discovered, we will explain the situation and, where appropriate, provide a price for additional remedial work.

17. CUSTOMER RESPONSIBILITIES

The customer is responsible for providing:

  • accurate information regarding the proposed work;

  • safe and reasonable access to the property;

  • access to electrical intake equipment and consumer units;

  • access to relevant rooms and electrical accessories;

  • information regarding known hazards;

  • information about known asbestos;

  • details of hidden services where known;

  • landlord, freeholder or management-company permission where required;

  • planning permission where applicable and not included in our quotation; and

  • a reasonably clear working area.

Children, pets and other persons should be kept away from active working areas where appropriate.

Customers should notify us in advance if anybody at the property has specific requirements that could be affected by an interruption to the electrical supply.

18. ACCESS TO THE PROPERTY

The customer must ensure that we can reasonably access the property at the agreed time.

Where we attend an agreed appointment and cannot gain access due to circumstances within the customer's control, we may make a reasonable abortive-visit charge.

Any charge will reflect the time and costs actually and reasonably incurred.

19. ELECTRICAL ISOLATION

Electrical work frequently requires temporary isolation of part or all of the electrical installation.

This may temporarily interrupt power to:

  • heating;

  • lighting;

  • refrigeration;

  • freezers;

  • internet equipment;

  • CCTV;

  • alarms;

  • computers;

  • medical or accessibility equipment;

  • pumps;

  • EV charging equipment; and

  • other appliances.

Customers must inform us before work commences about equipment that requires continuous power or where interruption could cause significant loss or risk.

We will take reasonable care when isolating supplies.

We will not be responsible for unavoidable consequences of a necessary electrical isolation unless loss or damage results from our negligence or breach of legal duty.

20. SAFE WORKING

HRK Electrical Solutions Ltd has the right to stop, postpone or refuse work where we reasonably consider that conditions present an unacceptable health and safety risk.

Examples include:

  • exposed dangerous electrical equipment;

  • suspected asbestos;

  • unsafe structures;

  • flooding or significant water ingress;

  • aggressive or threatening behaviour;

  • uncontrolled animals;

  • unsafe access;

  • inadequate working space;

  • hazardous substances; or

  • interference from other persons.

Work may resume once appropriate controls have been put in place.

21. INSPECTION, TESTING AND FAULT FINDING

Inspection, testing and fault finding will be undertaken with reasonable care and skill.

Electrical testing may reveal previously unknown faults in an existing electrical installation.

Where testing identifies an unsafe condition, we may:

  • isolate a circuit;

  • leave equipment disconnected;

  • recommend immediate remedial works; or

  • advise that equipment should not be used.

We will explain the reason wherever reasonably possible.

Fault finding may be charged based on time spent investigating the fault unless a fixed price has specifically been agreed.

Because some electrical faults are intermittent or concealed, fault-finding work cannot guarantee that every defect will be immediately identified or permanently reproduced during the visit.

22. ELECTRICAL INSTALLATION CONDITION REPORTS

An Electrical Installation Condition Report, or EICR, is an assessment of the condition of an installation at the time of inspection.

The report is subject to:

  • the agreed extent of inspection;

  • sampling;

  • accessibility;

  • operational limitations;

  • agreed exclusions; and

  • limitations recorded on the report.

An EICR does not guarantee that concealed, inaccessible or uninspected parts of the installation are free from defects.

Where defects or departures are identified, these will be recorded and coded as appropriate.

Unless specifically included within the quotation, remedial work arising from an EICR is charged separately.

23. MATERIALS AND EQUIPMENT

Unless otherwise agreed, we will select products and equipment that we reasonably consider suitable for the intended installation.

Where a particular manufacturer, product, finish or specification has been agreed, we will endeavour to supply that product.

Where an agreed product becomes unavailable, discontinued or subject to unreasonable delays, we will discuss an appropriate alternative with the customer.

Manufacturer warranties remain subject to the manufacturer's own terms and conditions.

24. CUSTOMER-SUPPLIED PRODUCTS

Where a customer supplies electrical equipment or materials for us to install, we reserve the right to inspect those products before installation.

We may refuse to install equipment that we reasonably consider:

  • unsafe;

  • damaged;

  • counterfeit;

  • inappropriate;

  • incompatible;

  • inadequately rated; or

  • otherwise unsuitable for the installation.

We are not responsible for an inherent defect in customer-supplied equipment.

Additional labour arising from faulty, incomplete or incompatible customer-supplied products may be chargeable.

Our responsibility for the standard of our workmanship remains unaffected.

25. MAKING GOOD

Electrical work can require drilling, chasing, cutting or otherwise accessing walls, floors, ceilings and other finishes.

Unless expressly included within the quotation, our price does not include:

  • plastering;

  • decorating;

  • painting;

  • tiling;

  • carpentry;

  • specialist flooring repairs; or

  • other decorative finishing work.

We will exercise reasonable care when undertaking electrical work and will endeavour to minimise unnecessary damage.

The extent of any making-good work included will be stated within the quotation.

26. FLOORBOARDS, FLOORING AND FURNITURE

Where floorboards, flooring or furniture must be moved to complete the work, this should be agreed in advance where reasonably possible.

We will take reasonable care.

However, some existing materials may be:

  • brittle;

  • aged;

  • damaged;

  • glued;

  • concealed-fixed;

  • previously altered; or

  • otherwise difficult to remove without damage.

The customer should remove valuable or fragile possessions from the work area before work begins.

27. DUST, NOISE AND DISRUPTION

Electrical work can generate dust, noise and temporary disruption.

We will take reasonable steps to minimise these effects.

However, customers should expect some disruption during activities such as:

  • drilling;

  • chasing;

  • cutting;

  • lifting floors;

  • installing containment; and

  • accessing concealed wiring.

Customers should remove or appropriately protect particularly valuable or sensitive items.

28. CERTIFICATION

Where certification forms part of the agreed works, we will provide the appropriate documentation following completion of the relevant work and testing.

Depending on the work undertaken, documentation may include:

  • Electrical Installation Certificate;

  • Minor Electrical Installation Works Certificate;

  • Electrical Installation Condition Report;

  • schedule of inspections;

  • schedule of test results; or

  • other relevant electrical documentation.

Certificates and reports only relate to the work or installation described within them.

Certification of new work does not mean that unrelated parts of an existing installation are guaranteed to be free from defects.

29. BUILDING REGULATIONS

Certain types of electrical work may require notification under applicable Building Regulations.

Where notification is included within our quotation, we will arrange the relevant notification through an appropriate route available to us.

Where Building Control fees, applications or other third-party costs are required and are not specifically included in our quotation, they may be charged separately.

The customer remains responsible for obtaining permissions unrelated to our electrical work unless we have specifically agreed otherwise.

These may include:

  • planning permission;

  • landlord permission;

  • freeholder consent;

  • management-company approval; and

  • listed-building consent.

30. DNO AND OTHER THIRD PARTIES

Some electrical works require involvement from a Distribution Network Operator, energy supplier, meter operator, Building Control, manufacturer or other third party.

Examples may include:

  • service-head issues;

  • main fuse upgrades;

  • meter alterations;

  • supply upgrades;

  • earthing issues;

  • EV charger notifications;

  • solar or battery-related matters; and

  • alteration of equipment that we are not authorised to interfere with.

We cannot guarantee third-party attendance times, decisions or charges.

Delays caused by such organisations may affect our programme.

31. COMPLETION TIMES

Any proposed start or completion date is an estimate unless expressly stated in writing to be a fixed contractual deadline.

We will make reasonable efforts to meet agreed dates.

Completion may be affected by:

  • additional work;

  • unforeseen defects;

  • customer variations;

  • supplier shortages;

  • product delays;

  • weather;

  • illness;

  • third-party contractors;

  • DNO involvement;

  • access restrictions; or

  • other matters outside our reasonable control.

We will keep customers reasonably informed where significant delays occur.

32. WORKMANSHIP

We will perform our services with reasonable care and skill.

If you believe there is a defect in our workmanship, please notify us as soon as reasonably practicable.

We should normally be given a reasonable opportunity to:

  • inspect the alleged defect;

  • identify its cause; and

  • where we are responsible, carry out appropriate remedial work.

This does not restrict any statutory rights available to consumers.

Any separate workmanship warranty expressly offered by us will be in addition to statutory rights.

33. MANUFACTURER WARRANTIES

Products supplied by us may carry a manufacturer's warranty.

Where applicable, we will provide reasonable assistance with legitimate warranty claims relating to equipment we have supplied.

Manufacturer warranties do not cover problems caused by matters including:

  • misuse;

  • accidental damage;

  • alterations by others;

  • environmental conditions outside the product specification;

  • failure to follow manufacturer instructions; or

  • faults elsewhere within the electrical installation.

Your statutory rights are not affected.

34. WORK UNDERTAKEN BY OTHERS

We are not responsible for defective work undertaken by another contractor or person.

Where another party alters, disconnects, damages or interferes with electrical work completed by HRK Electrical Solutions Ltd, we may charge for any additional inspection, testing or remedial work required.

35. SUBCONTRACTORS

We may use suitably skilled and competent subcontractors where appropriate.

Where a subcontractor is engaged by HRK Electrical Solutions Ltd to perform part of our contractual obligations, we remain responsible to the customer for the work we have agreed to provide, subject to these Terms and applicable law.

36. PHOTOGRAPHS

We may take photographs before, during and after electrical works for purposes including:

  • recording existing conditions;

  • certification;

  • inspection records;

  • evidence of defects;

  • evidence of work undertaken;

  • technical support;

  • warranty claims; and

  • protection in the event of a dispute.

Use of photographs containing personal information will be handled in accordance with our Privacy Policy.

We will seek appropriate permission where identifiable customer or property information is to be used for promotional purposes where consent is required or appropriate.

Our Privacy Policy is available at:

www.hrk-electrical.com

37. PERSONAL INFORMATION

Personal information will be processed in accordance with our Privacy Policy and applicable UK data-protection law.

Our Privacy Policy explains:

  • information we collect;

  • why we use it;

  • who we may share it with;

  • how long we retain it;

  • your data-protection rights; and

  • how to contact us regarding privacy matters.

38. DAMAGE TO PROPERTY

We will exercise reasonable care while working at your property.

We will not be responsible for damage arising solely from:

  • existing defects;

  • deteriorated materials;

  • unsafe previous alterations;

  • defective construction;

  • concealed damage;

  • inaccurate information provided to us; or

  • circumstances that could not reasonably have been identified prior to starting work,

except where loss or damage results from our negligence, breach of contract or another liability that cannot lawfully be excluded.

39. LIMITATION OF LIABILITY

Nothing within these Terms excludes or limits liability where doing so would be unlawful.

In particular, nothing excludes liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation or other liability that cannot legally be excluded.

Consumers

Where you are a consumer, we are responsible for reasonably foreseeable loss or damage caused by our breach of contract or failure to use reasonable care and skill.

We are not responsible for losses that were not reasonably foreseeable or losses attributable to circumstances outside our responsibility.

Business customers

Where you are a business customer, to the extent permitted by law, we will not be liable for purely indirect or consequential business losses including:

  • loss of profit;

  • loss of business;

  • loss of opportunity;

  • loss of anticipated savings; or

  • business interruption,

unless expressly agreed otherwise or liability cannot legally be excluded.

40. FORCE MAJEURE AND EVENTS OUTSIDE OUR CONTROL

We will not be responsible for failure or delay in carrying out work caused by events outside our reasonable control.

These may include:

  • severe weather;

  • fire;

  • flooding;

  • widespread power failure;

  • industrial action;

  • government action;

  • supplier failure;

  • major transport disruption;

  • epidemic or public-health restrictions;

  • utility-provider failure; or

  • other comparable events.

We will take reasonable steps to minimise disruption and resume work when practicable.

41. TERMINATION

We may terminate or suspend a contract where there is a serious reason for doing so, including:

  • non-payment of undisputed amounts;

  • threats or abusive behaviour;

  • unsafe site conditions;

  • repeated failure to provide access;

  • material breach of the agreement; or

  • circumstances making lawful or safe completion impossible.

Where a contract is terminated, the customer remains responsible for amounts properly due for:

  • work completed;

  • materials supplied;

  • materials reasonably ordered for the project; and

  • other amounts properly payable under the contract.

Consumer statutory rights remain unaffected.

42. COMPLAINTS

If you are unhappy with our service, please contact us as soon as reasonably possible.

Please provide:

  • your name;

  • property address;

  • quotation or invoice number where available;

  • details of the problem; and

  • what you would like us to investigate.

We will investigate complaints fairly and aim to resolve legitimate concerns within a reasonable period.

Where the complaint concerns workmanship, we should normally be given a reasonable opportunity to inspect the work and, where appropriate, rectify it before third-party remedial work is commissioned.

This does not restrict any statutory consumer rights or prevent emergency action where reasonably necessary.

43. DEBT RECOVERY

Where an undisputed invoice remains unpaid after reasonable requests for payment, HRK Electrical Solutions Ltd reserves the right to commence appropriate recovery action.

This may include:

  • reminders;

  • formal demands;

  • debt-recovery agents;

  • a letter before action; and

  • court proceedings.

We may seek interest, compensation and recovery costs where legally entitled to do so.

44. SEVERABILITY

If any part of these Terms is found to be invalid, unlawful or unenforceable, that provision will be treated as removed or modified to the minimum extent necessary.

The remaining provisions will continue to apply.

45. CHANGES TO THESE TERMS

The Terms applicable to a particular contract will normally be those supplied or made available when the contract was entered into.

We may update these Terms from time to time for future work.

We will not retrospectively change the terms of an existing contract where customer agreement is legally required.

46. GOVERNING LAW

These Terms and any contract between HRK Electrical Solutions Ltd and the customer are governed by the law of England and Wales.

Where you are a consumer, nothing in this clause removes any mandatory rights you may have regarding where legal proceedings can be brought.
